Website Terms & Conditions of Use

1. Acceptance of the Terms & Conditions of Use

Welcome to GrandPalaisRmnPhoto website (hereinafter the “Website”). Access to the Website and the terms of use of the Website and the Images are subject to these General Terms and Conditions of Use (hereinafter the "T&C").

The user's access to the Website and its functionalities is subject to unreserved acceptance of these T&C. Users declare that they are over 18 years of age and have full legal capacity to accept these T&C.

2. Functionalities of the Website and conditions of use of images

The Website provides users with free access to GrandPalaisRmn images for educational and non-professional information on images or album published on the website (album consists of thematic grouping of images published on the website), excluding any other commercial use.

In addition, the Website provide users with other functionalities, only for educational professional and non-professional information, excluding any other commercial use of images:

- To closely research images through images and album published on the Website;

- To select, save and print images in pdf format ; to make use of this functionality, user must have a user account.

3. Creation of a user account

In order to benefit from some of the Website's functionalities, users must create a personal account ("user account") by completing the form "Register". When creating their account, users undertake to provide accurate, up to date and complete information.

To create their account, users must state their name, choose their password and provide a valid, personal e-mail address. The user account may be activated by clicking on the activation link in the confirmation e-mail sent by Grand Palais-Rmn. Once the User account is activated, Users may access their account details and update them at any time.

Entering any false, inaccurate, out of date or incomplete information, or a user name that contains harmful, defamatory, violent or obscene terms, or more generally inappropriate terms, may lead to the suspension or closure of the user account.

More generally, GrandPalaisRmn reserves the right to suspend or delete a malicious user account, or in the event of breach of these T&C or breach of legal or regulatory provisions.User accounts which impersonate the identity of a third party will be deleted. Any online impersonation of the identity of a third party using any data that identifies the latter (name, e-mail address, photograph etc.) is an offence punishable by law (Article 226-4-1 of the French Penal Code).

Users are solely responsible for use of their account. Users will therefore ensure that their login details are kept confidential and will take all measures necessary to keep them confidential.

4. Intellectual property

The structure of the Website, as well as all its components, notably photographs, text, animated images, graphs, software, databases, trademarks and other distinctive signs are protected by French intellectual property law.

Any reproduction, representation, use, making available or amendment of the Website and/or of its component parts, in whole or in part, by any process whatsoever, is strictly prohibited without the prior written agreement of Rmn-GP, the rights holders and/or authors and/or assignees concerned.

Therefore, users of the Website shall not, by any means or process under any entitlement whatsoever, including for personal use, notably:

- download, copy or forward and/or broadcast, in any form whatsoever, such as networking or by public communication, all or part of the Website;

- use methods for data mining, robots or methods for collecting or retrieving similar data;

- manipulate or display, all or part of the website, using "raming" technology or similar;

- introduce elements, which could amend all or part of the website, notably images published thereon and all the editorial content;

- use all or part of the Website for other purposes than the one provided by these terms and conditions of use.

Use of the name "GrandPalaisRmn" and/or of one of its components and/or its logo, alone or in association, by reproduction or imitation, under any entitlement and on any medium whatsoever, is strictly prohibited without the prior written agreement of GrandPalaisRmn.

Failure to comply with these prohibitions constitutes counterfeiting which may give rise to the perpetrator’s liability under civil and/or criminal law. GrandPalaisRmn reserves the right to bring legal proceedings against any person failing to comply with the aforementioned prohibitions.

5. Hypertext links

In the Website, there are many links to other websites intended to add information for the user on the photographs in the Portal, their author and their custodian. As these web pages are not part of the Website and GrandPalaisRmn has no control over these websites, the latter cannot incur any liability regarding the content, quality, nature and reliability of these websites.

The Website authorizes the insertion of a hypertext link pointing towards its content, subject to the following conditions:

- No "deep linking" technique may be used; pages of the Website must be accessible by opening a new window/tab;

- A reference to the source that will directly point to the content concerned via a hypertext link;

- Statement www.photo.rmn.fr included in the title tag

- Strict compliance with the authorized uses referred to above in the heading "intellectual property";

- All uses for commercial/advertising/editorial purposes are prohibited;

- This authorization does not apply to websites publishing information of a polemic, pornographic or xenophobic nature or which may offend the general public.

6. Protection of personal data

Your data is used by GrandPalaisRmn, as the data controller. GrandPalaisRmn collect your data in order to manage your user account, process your request and, if you agreed, send you the newsletter of the Photo agency.

Your data is intended for the internal services of GrandPalaisRmn, its service providers and sub-contractors involved in managing the Website and/or the data. Your data is kept for the time necessary to fulfil each relevant purpose and then archived with restricted access and stored for the additional time necessary to comply with our legal obligations or to defend or assert our rights.

In accordance with the European Regulation n°2016/679/EU of 27 April 2016 on the protection of personal data, users have the right to access, rectify, delete, portability and limit the processing of their personal data. Users also have the right to object to the processing of their personal data.

- your surname, first name and email and any information that would allow us to be able to easily identify you in our systems

The rights that users enjoy are individual rights and can therefore only be exercised by the owner of the data or by an authorised representative.

7. Exclusion of guarantee and of liability

Under no circumstances may GrandPalaisRmn or third parties involved in creation or maintenance of the Website be held liable to any user for direct or indirect damage, including loss of use, loss of profits or of data which may be linked in any way whatsoever to exploitation or use of the Website in whole or in part.

All costs for use of external services, all costs for repairs and/or corrections caused by use of all or part of the Website, are the exclusive responsibility of the user.

GrandPalaisRmn offers a search function on the Website; it expressly disclaims any responsibility concerning the content, availability or exhaustiveness of the search results.

8. Miscellaneous provisions

GrandPalaisRmn may, at any time, amend the provisions of these T&C; these amendments shall bind the Website user once they are published on line.

The entire Website is subject to French law; any dispute concerning the foregoing provisions falls exclusively within the jurisdiction of the Paris Court of First Instance.
